    Yes without phase current control the controller should match the motor , the capacitors will let the mosfets dump any current the motor wants but you will not see that in the battery current shunt as this measures only average . How does this simple controller know what load it is attached to...

    Isn't the whole phase current stuff not easy to see on a scope ? Use low resistance shunt or maybe even the phase wire itself and see what the current does with the different PWM rates... It may give an easy answer to all this discussion :)
